2. The petitioners claim that, despite their involvement, the Apex companies do not issue staffing orders, but continue to fill the available positions through day labour, on a contract basis or in other improper ways. They therefore pray that ApexSocieties will be directed to appoint them promptly to the available positions in accordance with letters of recommendation to be issued by the PSC.

4. Since the facts in these cases are not in dispute, I need not go into detail about them.
5. As I said above, the petitioners will be included in a common ranking prepared by the PSC for appointment to the post of LDCs in the various Apex Societies.
6. The petitioners claim that despite the fact that the above societies have sanctioned positions of LDCs in their service, they refuse to make appointments from this ranking.
7. Therefore, the relevant question is whether the ranking is in force and whether there are sanctioned posts in the various Apex Societies to accommodate those on it, including petitioners.
8. Sri.M.Sasindran - Trained Legal Counsel for CONSUMERFED, stated that there are no sanctioned positions of LDCs in the service of his client.
9. Sri.Manu Govid - Trained Legal Counsel for WP(C) No.15630/2020 & Con. cases10KERAFED submitted that the special arrangement in relation to its client has not yet been approved by the government and therefore no facilities are available to accommodate the petitioners.
10. Sri.M.A.Asif - Senior Legal Counsel at Kerala State Co-operative Agricultural and Rural Development Bank, submitted that the entry position in the service of his client is an assistant and therefore petitioners cannot seek appointment against the same.
11. Sri.T.P.Pradeep - Senior Legal Counsel for MATSYAFED, stated that the draft of the Special Rules relating to his client was originally approved in 2016 but various changes were made to it which are again for the Government's consideration had been submitted, which led to a final competition on February 25th, 2020. He submitted that in the meantime, on 02/13/2020, his client had reported all available positions on the LDC position to the PSC because, under the new special rules, the qualifications and criteria for the position in question had been completely changed. 12. As far as the legal advisors of the other Apex companies are concerned, they say that all sanctioned vacancies available in their services have already been reported to the PSC.
13. It is therefore undeniable that it is undisputed that LDC's sanctioned and available positions in all ApexSocieties can only be filled from the relevant ranking, as this is still in force and will not expire until 02/25/2023. As most of them have already reported vacancies to the PSC, this authority must now issue Advise Memos on the basis of the same, so that the petitioners can be appointed to the services of the respective companies without further delay.
14. As far as KERAFED is concerned, Sri Manu Govind, their scholarly Permanent Counsel, says that there are no special rules and therefore there are no sanctioned offices of LDC, the petitioners cannot seek to be appointed there at least until such time as which the special rules are approved.
15. As for CONSUMERFED, as they say there are no LDC sanctioned items in their services, WP(C) NO.15630/2020 & Con. cases12Again, the petitioners cannot request appointment to another post unless they can contact the competent authority and ensure that such posts are created or made available.
16. Coming to the arguments of Sri.M.A.Asif recorded above
- Qualified Permanent Counsel representing Kerala State Co-operative Agricultural and Rural Development Bank, Sri.P.V. Baby - petitioner's legal adviser by training in W.P(C)Nr and that they are creating an excuse to avoid appointment from the ranking in question. This question must certainly be considered by the competent authority of the PSC, as this court will not be able to verify that the offices are equivalent. I therefore believe that the PSC must consider these rival claims and then issue counseling memos to eligible candidates.
17. As far as the MATSYAFED is concerned, although their learned Counsel in Law made the above submission, WP(C) NO.15630/2020 & Con. cases13Ext.P8 in W.P(C)No.2918 of 2021 would make it revealing that the special rules relating to their services were approved in 2016. This is clearly stated by his General Manager in the said document and I don't understand how they can now take a contrary position. From this perspective, when the ranking came into effect after the special rules were reviewed, MATSYAFED can only appoint the LDC's sanctioned posts from the ranking and in no other way. Of course, I take input from Sri.P.C.Sasidharan – a PSC permanent legal adviser by training – that there are certain NJD bodies as far as MATSYAFED is concerned and that his client will deal with the same legal issues if this court is so inclined is.
In the circumstances set out above, I order these written motions in the following manner:
a) Except in the case of KERAFED and CONSUMERFED, the PSC will promptly issue letters of recommendation to all candidates in the rankings, depending on their placement therein; which no later than one month after receipt of WP(C) NO.15630/2020 & Con. must take place. cases14a copy of that judgment.
b) The respective ApexSocieties shall appoint the suitable candidates promptly, but no later than two weeks thereafter, following the issuance of such opinions.
c) In order to fully comply with the above instructions, I instruct the Apex companies, with the exception of KERAFED and CONSUMERFED, to report any available vacancies on the post of LDC, like today, to the PSC within a period of one week the date of receipt of a copy of that judgment.
d) I leave the petitioners free to persuade the competent governmental agency in relation to KERAFED and CONSUMERFED either to create the bodies there or to appoint them simultaneously; and when an application is made by the applicants, it shall be legally examined by that authority without unavoidable delay but no later than two months after the date on which such application is made.
e) With respect to the Kerala State Cooperative Agriculturaland Rural Development Bank, the PSC will hear them, as will WP(C) NO.15630/2020 & Con. casesfifteenthe petitioner in WP(C)No.15630 of 2020, and then decide whether the position of “assistant” in their service is the same as that of the LDC under the Kerala Co-operative Societies Rules (“KCS Rules” for short); and if so determined, it will issue AdviceMemos to the candidate, including the petitioners in all such cases, according to their position in the rankings, within a period of one month after the completion of such investigation. This is separate from any testing that may have been carried out by the PSC in relation to the post of assistant in the above bank after this ranking came into effect.
(f) It is to be understood that in light of the foregoing instructions, any notice issued by the above corporations to fill the sanctioned vacancy of LDC or equivalent, other than from the Ranking List, will be waived until expiration.
